Terms of Service
1. Agreement
These Terms of Service ("Terms") govern your access to and use of TapCard ("Service"), operated by:

By accessing or using TapCard, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use TapCard. If you are between 13 and 16 (or the digital consent age in your country), you may only use the Service with the consent of a parent or guardian.
By using the Service, you represent that:
- You meet the age requirements above
- You have the legal capacity to enter into this agreement
- You will use the Service in accordance with these Terms and applicable laws
3. The Service
TapCard is a digital business card service that allows you to:
- Register and customize a digital business card
- Share your card via NFC, QR code, or URL
- Manage your contact information and online presence
We may add, change, or remove features at any time. We will provide reasonable notice for material changes that affect your use of the Service.
4. Your account
4.1 Account creation
You register an account by entering your email address. We send magic link authentication emails to verify your identity. You are responsible for keeping your email and PIN secure.
4.2 Your card
Your TapCard is publicly accessible to anyone with the URL or NFC tag. You control what information is displayed.
4.3 Account security
You are responsible for all activities under your account. Notify us immediately at hello@tapcard.me if you suspect unauthorized access.
5. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose
- Impersonate any person or entity
- Upload false, misleading, or defamatory information
- Upload content that infringes intellectual property rights
- Upload obscene, harassing, or hateful content
- Attempt to gain unauthorized access to other accounts or systems
- Use automated tools (bots, scrapers) to access the Service
- Interfere with or disrupt the Service or its infrastructure
- Resell or commercially exploit the Service without permission
We reserve the right to remove content or suspend accounts that violate these rules.
6. Your content
6.1 Ownership
You retain all rights to the information and content you provide ("Your Content").
6.2 License to us
You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and transmit Your Content solely for the purpose of providing the Service.
6.3 Responsibility
You are solely responsible for Your Content and the consequences of sharing it publicly. Do not include information you are not authorized to share.
7. Free and paid plans
TapCard is currently offered as a free service. We may introduce paid plans in the future. If you subscribe to a paid plan:
- Pricing and features will be clearly disclosed before purchase
- Subscriptions renew automatically unless cancelled
- Refund terms will be provided in accordance with the Australian Consumer Law
8. Intellectual property
The Service, including its design, logos, software, and content (excluding Your Content), is owned by Lee, Dongwook and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without permission.
9. Disclaimers
9.1 As-is service
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9.2 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies that you have under the Australian Consumer Law or any other applicable law that cannot be excluded.
9.3 No guarantee of availability
We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may suspend the Service for maintenance, updates, or other operational reasons.
10. Limitation of liability
To the maximum extent permitted by law:
- Our total liability for any claim arising from or related to the Service is limited to AUD $100 or the amount you paid us in the 12 months before the claim, whichever is greater.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.
This limitation does not apply to liability that cannot be excluded under applicable law, including under the Australian Consumer Law.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:
- Your use of the Service
- Your Content
- Your violation of these Terms or applicable law
- Your violation of any third-party rights
12. Termination
12.1 By you
You may stop using the Service at any time. You can delete your account by contacting hello@tapcard.me.
12.2 By us
We may suspend or terminate your access if you violate these Terms, engage in fraudulent or harmful behavior, or as required by law. We will provide notice where reasonably possible.
12.3 Effect of termination
Upon termination:
- Your access to the Service ends
- Your data is handled per our Privacy Policy
- Sections that by their nature should survive (intellectual property, disclaimers, limitations, indemnification) remain in effect
13. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Last updated" date
- Sending an email notification for significant changes
- Requesting re-consent where required by law
Continued use after changes constitutes acceptance of the new Terms.
14. Governing law and dispute resolution
These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or the Service shall be resolved in the courts of Queensland, Australia, except where mandatory consumer protection laws of your jurisdiction provide otherwise.
For users in the European Economic Area, you may also have recourse to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
15. Miscellaneous
15.1 Entire agreement
These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the Service.
15.2 Severability
If any provision is found to be unenforceable, the remaining provisions remain in full force.
15.3 No waiver
Our failure to enforce any provision does not constitute a waiver of our right to do so later.
15.4 Assignment
You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
